"Recess Appointments": Obama Tramples Further on the Constitution
President Obama is pressing ahead with his threat to ignore Congress and rule by decree, as witnessed on Jan. 5 by the four "recess appointments" he made, even though Congress has not recessed. This move is without precedent, say legal experts cited by Politico and by the New York Times.
Speaking at a political-style rally in Cleveland, Obama decreed that the new Consumer Finance Protection Bureau shall be headed by Richard Cordray, and he also named three others to fill vacant positions on the National Labor Relations Board. These are all positions that require confirmation by a majority of Senators. The only exception is that, when the Senate is not in session, the President is authorized to fill on an emergency basis any vacancies that occur.
That is not the case right now, as since the Christmas holidays, the Senate is meeting in pro forma session every couple of days. However, in the same announcement, Obama declared dictatorally: "I refuse to take 'no' for an answer," in an apparent reference to Constitutional limitations on his power.
This latest flagrant push for exorbitant powers by Obama has been widely denounced, as yet another effort to completely shut out the Senate, i.e. those officials elected by the people.
